1. Acceptance of Terms

Welcome to ISEFY. These Terms of Use ("Terms") govern your access to and use of the ISEFY website, mobile application, software, cloud services, devices, subscriptions, and related services (collectively, the "Services") provided by ISEFY Technologies Ltd. ("ISEFY", "we", "our", or "us").

By accessing or using the Services, creating an account, purchasing a product, or installing ISEFY software, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Eligibility and Authority

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or use the Services.

If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. ISEFY Account

Some Services require an ISEFY account. You agree to provide accurate and complete account information, keep your login credentials secure, and promptly notify us of any unauthorized access or suspected security issue.

You are responsible for all activity that occurs under your account, except where the activity results from ISEFY's failure to meet its legal obligations.

We may suspend or restrict access to an account if we reasonably believe that the account has been compromised, used unlawfully, or used in violation of these Terms.

4. Devices, Applications, and Service Features

ISEFY products and Services may include security cameras, video doorbells, network video recorders, mobile applications, firmware, cloud storage, artificial intelligence features, alerts, and related smart home services.

Certain functions may require internet access, compatible hardware, mobile device permissions, firmware or software updates, cloud connectivity, or an active subscription. Feature availability may vary by product model, region, device settings, network conditions, and subscription plan.

You are responsible for installing and using ISEFY devices in compliance with applicable laws, including laws relating to privacy, recording, monitoring, property access, and notification requirements.

5. Purchases, Subscriptions, and Paid Services

Products, subscriptions, cloud storage, and other paid Services may be subject to additional purchase terms presented at the time of sale. Those terms may include pricing, taxes, payment method, billing cycle, renewal, cancellation, refund, and trial information.

Before submitting an order, you are responsible for reviewing the product, quantity, shipping information, taxes, fees, and total price. An order is accepted only when ISEFY or its authorized sales channel confirms acceptance or shipment, unless otherwise stated at checkout.

If a product or Service is unavailable, incorrectly priced, or cannot be provided, ISEFY may cancel the order and issue a refund of amounts paid for the unavailable item or Service.

If you subscribe to a recurring paid Service, you authorize the applicable payment provider to charge the fees disclosed at checkout unless you cancel in accordance with the applicable cancellation process.

Failure to maintain an active subscription may limit or end access to certain cloud-based features, including video history, advanced notifications, or other paid functions.

6. User Content

You retain ownership of content that you upload, record, store, transmit, or generate through the Services, including videos, images, audio recordings, device settings, and related information ("User Content").

You grant ISEFY a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and otherwise use User Content only as necessary to provide, secure, maintain, improve, and support the Services, comply with law, and enforce these Terms.

You are responsible for ensuring that you have the rights and permissions needed to use, record, upload, and share User Content through the Services.

7. Privacy Policy

Our Privacy Policy is a separate document that explains how ISEFY collects, uses, discloses, stores, and protects personal information in connection with the Services.

Please review the Privacy Policy at https://www.isefy.com/legal/privacy-policy. These Terms govern use of the Services; the Privacy Policy governs personal information practices.

8. Electronic Communications

When you use the Services, create an account, place an order, contact us by email, or receive notices through the website or application, you are communicating with us electronically.

You consent to receive service-related communications electronically, including account notices, product notices, security alerts, subscription information, and updates to legal terms, unless applicable law requires another form of notice.

9. Acceptable Use

You agree not to use the Services to:

  • violate any applicable law, regulation, court order, or third-party right;
  • record, monitor, or surveil people where doing so is unlawful or requires consent that you have not obtained;
  • access, attempt to access, or interfere with another user's account, device, data, or network;
  • disable, bypass, overload, damage, or interfere with the security or operation of the Services;
  • upload, transmit, or introduce viruses, malware, harmful code, or unauthorized automated tools;
  • reverse engineer, decompile, disassemble, or attempt to extract source code from the Services, except where permitted by law;
  • resell, lease, sublicense, or commercially exploit the Services except as expressly authorized by ISEFY.

10. Downloads, Security, and Viruses

You are responsible for using appropriate security measures, including anti-virus protection, secure passwords, and safe network practices, when accessing the Services or downloading files, software, firmware, manuals, or other materials.

You must not knowingly introduce viruses, malware, logic bombs, denial-of-service attacks, or other harmful or disruptive code or activity into the Services, ISEFY systems, or any connected network.

ISEFY may investigate suspected security incidents and may cooperate with law enforcement or regulatory authorities where required or permitted by law.

11. Intellectual Property

The Services, including software, firmware, applications, website content, trademarks, logos, product designs, interfaces, algorithms, documentation, and related technology, are owned by ISEFY or its licensors and are protected by intellectual property and other laws.

ISEFY grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose and in accordance with these Terms. No ownership rights are transferred to you.

You may not use ISEFY names, logos, product names, service names, designs, slogans, or other marks without ISEFY's prior written permission, except where permitted by law.

12. Software and Firmware Updates

ISEFY may provide updates, patches, bug fixes, feature changes, or security improvements for software and firmware. Some updates may be installed automatically or may be required for continued use of certain Services.

You agree that ISEFY may modify, improve, suspend, or discontinue features where reasonably necessary for security, legal compliance, compatibility, service reliability, or product improvement.

13. Third-Party Services

The Services may integrate with or link to third-party platforms, applications, voice assistants, payment processors, cloud infrastructure providers, or other services. Third-party services are governed by their own terms and policies.

ISEFY is not responsible for the availability, content, security, or practices of third-party services, except to the extent required by applicable law.

14. Service Availability and Security

We aim to provide reliable Services, but we do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.

Service availability may be affected by maintenance, updates, device settings, network conditions, internet outages, third-party service interruptions, power failures, or events beyond our reasonable control.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. ISEFY disclaims all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

ISEFY products and Services are intended to assist with monitoring, alerts, and security-related awareness, but they are not a substitute for emergency services, professional security services, or personal judgment. You remain responsible for responding appropriately to events, alerts, and local conditions.

16. Limitation of Liability

To the maximum extent permitted by law, ISEFY and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to the Services or these Terms.

To the maximum extent permitted by law, ISEFY's total liability for any claim arising out of or related to the Services or these Terms will not exceed the amount you paid to ISEFY for the specific product or Service giving rise to the claim during the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the limitations above apply only to the extent permitted by law.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ISEFY and its affiliates, officers, employees, agents, suppliers, and licensors from claims, damages, liabilities, costs, and expenses arising from your misuse of the Services, violation of these Terms, violation of law, or infringement of third-party rights.

18. Termination

You may stop using the Services at any time and may request account deletion through the available account or support channels.

ISEFY may suspend or terminate your access to the Services if you violate these Terms, create security or legal risk, fail to pay applicable fees, or where suspension or termination is required by law.

Sections that by their nature should survive termination will continue to apply, including sections concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

19. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website or made available through the Services, and the "Last Updated" date will be revised.

If changes are material, we will provide notice as required by applicable law. Continued use of the Services after updated Terms become effective means you accept the updated Terms.

20. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of Canada, without regard to conflict of law principles, unless mandatory consumer protection laws require otherwise.

Before starting a formal legal proceeding, you agree to contact ISEFY and try to resolve the issue informally. This section does not limit any rights you may have under applicable consumer protection laws.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. No Agency Relationship

Nothing in these Terms creates any partnership, joint venture, employment, franchise, agency, or fiduciary relationship between you and ISEFY.
